Apple 1:21 Rob Janoff, the designer who came up with the world-famous Apple company logo, explained his idea in one of his interviews. He bought a bag of apples, placed them in a bowl, and spent time drawing them for a week, trying to break the image down into something simple. Vaio 1:58 The first two letters of the Vaio logo symbolize an analogue wave. The last two are similar to the numbers 1 and 0 — that is, symbols of a digital signal. Amazon 2:14 The orange arrow is similar to a smile because the company wants its customers to be satisfied. Formula 1 3:41 If you look carefully at the white space between the letter ’F’ and the red stripes, you can see the number 1. Pinterest 3:59 On Pinterest, people collect images they like from across the Internet and ’pin’ them to their online boards. That’s why the image of a pin is hidden in the letter P. Beats 4:17 Beats, an audio equipment producer based in the USA, uses a logo in which the letter ’B’ looks like headphones on a person’s head. Toblerone 4:32 The famous chocolate company based in Bern, Switzerland, has a silhouette of a bear in its logo. That's because Bern is sometimes called a city of bears. BMW 4:55 The logo is simply a part of the Bavarian flag, the area of Germany where the company originated. LG 5:18 The logo is a stylized image of a person’s face. According to the company, this represents its aspiration to have human relations with their customers. Evernote 5:34 The corner of the elephant’s ear is folded over in a similar way how people fold the corner of a page to make notes. The names and logos of famous brands have a secret meaning you've never heard of. Each company logo has a story behind it. Many brand names seem meaningless to us but have an interesting explanation in the language of the country they come from. “Lego” means “play well” in Danish, “Fanta” comes from German “Fantasie”, Chupa Chups was named so after the Spanish verb “chupar”, which means “to suck”, “Samsung” is Korean for “3 stars”. “Pandora” has to do with a myth of the creation of the first human woman named Pandora. You’d think that the most successful companies in the world invest good money for their logos to be picture-perfect, yet even Google isn’t immune to messing up a logo design. Pay attention to 10 super famous company logos that are hiding something or have design fails and mistakes in them. We all know what the White House looks like, and you’d think there’d be no possible difficulties recreating it in an image. However, there were at least 3 attempts to create a logo, all of which resulted in mistakes. Wikipedia’s logo representing knowledge has a really embarrassing mistake right in the middle of the image! You wouldn’t catch it unless you know Chinese, so we’ll let you in on the big secret. Some people saw a man bending over vomiting in the London Olympics logo, while others were joking that it looked like Lisa Simpson in a compromising position. Salvador Dali hired to design the Chupa Chups logo put the brand’s name on a bright daisy and insisted that the logo be placed on top of the wrapper so that everyone could see it. And it’s basically stayed the same since then! When asked about the imperfection of letter “G” in their logo, Google chose the best route a person can when explaining his or her mistakes. We are constantly bombarded with so many icons and logos that we rarely stop to look further into them, but there are some very interesting and bizarre secrets hiding within these 10 famous logos! 1. Hyundai Bet you think the H logo is just the first letter of the South Korean car manufacturer Hyundai? Of course you do! But it actually represents two figures: the happy client shaking hands with the Hyundai salesman, cleverly projecting the subliminal message of a successful car purchase. 2. Apple It was Rob Janoff who was tasked with creating the apple logo back in 1977. Janoff bought a bag of apples and spent the week sketching them, trying to represent the perfect angle where the fruit couldn´t be mistaken for a cherry. Domino's Pizza In 1960 College dropout Tom Monaghan borrowed $900 to by a tiny pizza placed called Dominic's. 5 years later he bought 2 more locations. The former owner refused Tom the permission to use his name in the franchise so Tom turned it into Domino's. The dice in the logo represent the first restaurant that he bought, followed by the next two, and he had planned on adding numbers on every new opening. That was before he realized how big the franchise would become. 10. Unilever Who is Unilever, right? It's actually a huge corporation which owns over 400 famous brands. You've only got to look on the back of any of these popular products to find their logo hiding there. (Axe, Lipton, Ben and Jerry's, Dove, Heartbrand, Hellman's) But that's not all, the actual unilever logo is made up of 25 smaller logos, each with a rich meaning. Well, this is a great, and complex question. First off, a trademark is... A distinctive word, symbol, or phrase that's affixed to goods or services in commerce as an indicator to identify their source or origin. Trademarks are Brands... Just like the brands that used to be burned into the hides of cattle to identify the ranch they came from. You acquire trademark rights by actually using the mark in interstate commerce to sell goods or services. Trademarks protect only against others using the same or confusingly similar marks in the same class of goods and services. So, if you have a trademark for a particular brand of medical device, you probably can't prevent the same mark being used for a line of shoes, or as a title for a TV series... Now, because we are talking about what the person describes as a "generic phrase" it's probably not distinctive enough for trademark registration just by itself. But, the inclusion of a stylized letter and distinctive design might make it registrable as a logo design. Now, the process isn't that hard. Nowadays, we do the applications online, and it's a step by step process. But it can be tricky because how you complete the application can have a big impact on whether or not the application gets approved. You might, for example, need to disclaim certain aspects of the mark, like the generic phrase in our readers’ situation. The best way to ensure your trademark gets registered, and you get all the benefits and protections, is to have a lawyer prepare the application for you. Those of us who do this a lot have learned about all the problem areas, and have a handle on the best practices to get things done right. My experience is that folks who do it themselves have their applications rejected more often, and then, unfortunately have to hire me to fix the problems they encounter. That usually costs as much or more than they'd have paid me to do the registration in the first place. Your trademarks, your brands, may someday be the most valuable assets your business owns. So, it makes sense to invest a little bit now to protect them, when doing so is relatively easy. Rather than paying a lot to clean up messes later. --- So, what's the proper or best business structure to maximize profit, minimize liability and protect assets from taxes and judgements? Well, there are several kinds of legal structures that can help on this. The most common, and most established is the corporation, which provides insulation from liability for shareholders. But corporations come with some administrative hoops you need to jump through, and they have to pay taxes separately, so income can sometimes be taxed twice. Sub chapter S corporations are for small, closely held companies, like family owned enterprises, and similar, where there are a small handful of shareholders... These corporations can be taxed like a partnership, where profits pass through directly to shareholders, so that double taxation doesn't happen. But these corporations also have the administrative hoops I mentioned before. An LLC offers most of the advantages of corporations, but can be taxed as a pass through entity, and don't have the same administrative hoops, but they’re not as well established forms of entities, and can have other tricky aspects. The bottom line is, I just can't give a general answer here. Every business is different, so you need to consult with an experienced business attorney (like me) who can help evaluate the situation and advise you accordingly. Getting this stuff right is important, and it's always best to handle these things as you're starting up, so you don't wind up having to backtrack, or unwind transactions later on when your structure changes. Invest a bit now, so you don't overspend on fixes later. When Should I Trademark My Name or Logo? - All Up In Yo' Business

Contact Aiden and learn more at www.180lawco.com. Someone asked me recently when is the best time to trademark your business name or logo. The simple answer: As soon as possible! Really, in general, the sooner the better for filing a trademark for your business name or logo. I discussed in a previous video that you have some trademark rights under common law even if you never register it with the U.S. Patent and Trademark Office (USPTO). But, having a registered trademark is infinitely better and it makes your trademark rights a lot stronger. So, even though you might have a common law trademark in something, its always better to actually register the trademark if you can. To register a trademark, you do have to be actively using whatever the trademark is in commerce. So, if your business is already established, i.e., you have a website or marketing materials using your business name or logo that you are trying to trademark, then you are actively using it in commerce and that will work in your favor when you try to get it registered. If you’re not quite there yet, for example, maybe all you have so far is a great logo, you can still file an application for the trademark. However it is an “intent to use” application… and it is exactly what it sounds like. It means that you are intending to use whatever the trademark is. So, that will buy you some time in being able to actively use that trademark in commerce, but still getting that protection if your trademark is ultimately registered. So, even if your business is not actively started yet, you can, in most cases, still file that intent to use application to get a head start on that trademark registration. So, simply put, the sooner you can file a trademark application, the better off you are. It basically gets you first in line in priority of using that trademark, assuming no one else has already used it. And if you are still getting your business started, you can file that intent to use application in order to get a little extra time for you to start using it actively in commerce. As an example, you do not want to launch a new car under the name of PMW – it would be too similar to BMW. I have a link to a detailed video in the shownotes how to conduct a search for earlier similar trademarks. Once you made sure that there are no conflicting earlier trademarks or company names, then you can actually file your trademark application with the intellectual property office of your country or region. Many trademark offices nowadays offer to file trademarks using a simple web form. You can navigate there and then enter the information that we compiled above. Once submitted, you can a receipt and the office will then start examining your trademark application. The trademark gets registered, if the office did not find any formal errors or did not object to the trademark application for other reasons such as descriptiveness of the mark. Once your trademark is registered, you can use the trademark e.g. to tell other competitors not to use identical or very similar names for the protected services. Or you can issue licenses to your trademark for other dance studio owners and make money that way. I hope I was able to show you how to protect a name or business name.
